To complete your registration or bid please read the following Terms and Conditions and Privacy Policy. By clicking on the Accept button at the bottom of the page or by placing a bid, you indicate that you have read and agree to the Terms and Conditions.

Auction Terms and Conditions

The items listed in this online catalog will be offered and sold by aPublic.org and its affiliate stations ("apublic.org").

Review Important Wine Delivery Information

The following terms and conditions, as amended by any posted notices or oral announcements during the sale, govern the sale of all the items listed herein:

1. a) No Liability: apublic.org and its employees and its agents do not assume any risk, liability or responsibility for the authenticity or quality of any items  presented in this online auction; (b) No Warranties: All items are sold "as is" without recourse and aPublic.org makes no representations or warranties of any kind or nature, expressed or implied, with respect to the catalog items and aPublic.org in no event shall be responsible for the correctness of the listing, nor be deemed to have made any representations or warranties of quality of same. No statement made here or at the sale, in any bill of sale, invoice or elsewhere, shall be deemed such a representation or warranty or assumption of liability. Prospective bidders should read the description and familiarize themselves with the terms, conditions, and restrictions before bidding to determine the appropriateness of the auction item and that the bidder’s sole recourse for any claim shall be through the manufacturer or provider of such product or service.

2. apublic.org may withdraw any auction item at any time before the actual sale. Unless otherwise announced by winecommune.com (the "auctioneer") at the time of sale, all bids are per lot as numbered.

3. All bids placed are binding agreements to purchase. If the highest value bid is not paid in full, the next highest bid will be deemed the purchasing bid. Bids will be considered in successive order until an item is paid for in full.

4. aPublic.org reserves the right, without giving any reason therefore, to reject a bid from any bidder. The highest bidder acknowledged by aPublic.org shall be the purchaser. In the event of any dispute between bidders, the auctioneer or aPublic.org shall have the sole and final discretion either to determine the successful bidder or to  re offer and resell the article in dispute. If any dispute arises after the sale, the aPublic.org sale records shall be conclusive in all respects.

5. If the auctioneer determines that any opening bid is not commensurate with the value of the article offered, he or she may reject the same and withdraw the article from sale, and if, having acknowledged an opening bid, he or she decides that any advance thereafter is insufficient, he or she may reject the advance.

6. At the end of the sale, the highest bidder shall be deemed to have purchased the offered item subject to all of the conditions set forth herein and thereupon (a) assumes the risk  and responsibility therefore and (b) will pay the full purchase price therefore or such part as aPublic.org may require. Unless otherwise stated, any travel expenses, meals, insurance or supplies needed are at the purchaser's  expense. If the foregoing conditions and other applicable conditions are not complied with, including, without limitation, the failure of the purchaser to pay the bid price, aPublic.org, at its option, may either(a) cancel the sale, retaining as liquidated damages all payments made by the purchaser or (b) resell the item for the account and risk of the purchaser, either publicly or privately, and in such event the purchaser shall be liable for payment of any deficiency, all other charges due hereunder and incidental damages.

7. If your credit card is declined, we will submit it a second time. Then, if payment is not confirmed, the item may be offered to the next highest bidder at the discretion of aPublic.org.  Payment shall be made immediately by this next highest bidder. The purchase price represents the value of the item purchased and is not a tax-deductible contribution to aPublic.org by purchasers, except for that amount of the purchase price, if any above fair market value. Following the auction, winners will be sent a receipt indicating the fair market value of their items for their tax records.

8. aPublic.org is not responsible  for errors or omissions arising out of or resulting from bids transmitted by Internet, including, without limitation, errors or omissions resulting from mechanical difficulties or failure.

9. These Conditions of Sale, as well as the purchaser's and aPublic.org's respective rights and obligations hereunder, shall be governed by and construed and enforced  in accordance with the laws of the state of Colorado. By bidding  at an  auction, whether present in person or by agent, order bid, telephone, Internet, or other means, the purchaser shall be deemed to have consented to the exclusive jurisdiction or the state courts or, and the federal courts sitting in, the state of Colorado.

10. Items in the auction involving experiences with public radio, TV or other media personalities are subject to cancellation without notice due to world events, breaking news or illness. In no cases will refunds be issued. Service provider will try to reschedule the experience at a mutually acceptable date, but cannot guarantee that the event will be rescheduled.

11. All items and/or experiences must be redeemed by the winning bidder within one year from the close of the auction unless otherwise indicated on gift certificates.
